Carol’s Story:

Carol is a European Trade Mark Attorney and Partner in FRKelly with over 15 years experience in Trade Mark Law and practise. Carol deals with all aspects of National, EU and International trade marks from clearance to registration including opposition, dispute resolution, and anti-counterfeiting. Carol coordinates the worldwide IP portfolios of a number of Irish companies and represents the trade mark interests of a broad range of International corporations. Carol also represents many SMEs and private individuals and work closely with start-ups providing strategic IP advice.

Carol has significant experience in advising on issues of registrability to make the protection easier to obtain and the registered mark easier to enforce, also focuses on tailoring filing programmes to specific clients needs and uses the International system to reduce client costs; advises on priority filing dates for foreign filing and negotiates regularly with her network of local foreign agents to ensure that the client is obtaining competitive pricing at all times; Monitoring potential Trade Mark conflicts for client; Experience in conducting regular portfolio audits in order to ensure that there are no gaps in protection be it in relation to the geographic scope of protection or the specification of goods; similarly audit the existing registrations to determine whether specific marks are still in use/ no longer of interest to the client.

Carol originally joined FRKelly in 2000 having studied Law in University College Dublin and Würzburg University in Germany and having completed a post grad in Financial Services Law.

Carol is the Vice Chair of the Cyberspace sub committee of Marques and also a member of the Internet Committee of INTA and the Law and Practice Committee of APTMA (Association of Patent and Trade Mark Attorneys) of Ireland. Carol is widely published in World Trade Mark Review, Lexology and various publications including AIB business.
